I am an Attorney, how do I obtain a Prosecutor's Recommendation?
ORIGINALS OF ALL PLEADINGS MUST BE FILED WITH THE COURT AND COPY TO THE PROSECUTOR

If you want the Prosecutor to review for a possible recommendation, please provide the following to the Prosecutor:
• Your request, a copy of ticket or what your client is charged with. If you don’t know, call the Court for the ticket and charge information. (online case look-up: municourt.net)
• SELF-ADDRESSED STAMPED ENVELOPE must be provided.

If the Violation is for:
• Not providing proof of financial responsibility (no proof of insurance),
• Driving without a license, driving revoked or suspended,
• Is the result of an accident.
You will need to provide proof of compliance (copy of insurance card, proof of valid license or reinstatement, letter from insurance company.) If you cannot provide supporting documents, then please indicate so.

If the Violation is DWI or NON-TRAFFIC:
• Follow the same steps indicated above. The Prosecutor will review and in most cases a court appearance WILL be required for final plea.

If you need an extension on the court dates, call the Court Clerk's Office at (636) 343-1007.

Once the Prosecutor has ALL the required documents, the Prosecutor will respond to your request. If you are provided a Recommendation/Plea form, the form will have a payment due date and court date.

THE ORIGINAL PLEA FORM WILL NEED TO BE SIGNED BY YOU AND YOUR CLIENT AND RETURNED TO THE COURT FOR APPROVAL BY THE JUDGE. PAYMENTS WILL NOT BE ACCEPTED AND PROCESSED AND THE CHARGE(S) WILL NOT BE AMENDED (IF OFFERED) UNTIL THE SIGNED PLEA FORM AND PAYMENT IS RECEIVED. IF THE PAYMENT AND COURT DATE PASS WITH NO FURTHER ANNOUNCEMENT, THE RECOMMENDATION MAY BE WITHDRAWN.

*Please note: The Court Clerk will not extend a due date recommendation. If your client needs more time, they will need to appear before the Judge on the court date provided on the recommendation.

ACCEPTANCE OF PROSECUTING ATTORNEY'S RECOMMENDATION: If the matter does not require a court appearance, the Prosecuting Attorney may provide a recommendation to the Attorney for their review and shall notify the Court that the recommendation has been extended to the Attorney. The Prosecuting Attorney will get a court date from the Clerk and shall include a court date in said recommendation for acceptance and payment of the recommendation and shall notify the Court that a recommendation has been provided. The Court shall continue the matter to the specific court date for disposition or trial setting. the Defendant and the Attorney must execute the recommendation plea form and forward the ORIGINAL executed document to the Court prior to the court date with payment in full. If payment is not made in accordance with the recommendation prior to the court date or paid in full on the court date, the Defendant and/or Attorney must appear in person on the court date and speak with the Judge. Partial payments are not to be accepted unless approved by the Judge. The Prosecutor may rescind the recommendation without further notice for failure to appear in Court.
